Know Your Rights : The P60 tax certificate

My employer says I will get a P60 in January. What is this?

Answer

A P60 is the tax certificate you receive from your employer at the end of each tax year. Its full title is ‘Certificate of Pay, Tax, Pay-Related Social Insurance, Universal Social Charge and Local Property Tax’.

The P60 is an important document. It states your pay during the year, the tax you paid and other deductions such as PRSI and Universal Social Charge. The P60 now also includes a record of Local Property Tax (LPT) paid, if you opt to have LPT deducted at source from your earnings.

If you need to claim a social welfare benefit you must give a P60 to the Department of Social Protection as evidence of how many PRSI contributions you paid in the year. You may also be required to provide a P60 as proof of your income, for example, if you are making a bank loan or mortgage application, if you are applying for social welfare payments or if you are applying for a student grant.

Your employer should give you your P60 for the previous tax year by 15 February of the following year. If your employer does not give you a P60 you should contact your local tax office. Revenue can contact your employer to obtain your P60 for you. Only an employer can issue a P60. However, Revenue can provide you with details of the pay and tax for the year in question as returned by your employer, which Revenue has on file.

If you stopped working for an employer before 31 December of the tax year you do not get a P60. You should get a P45 instead.

Know Your Rights : Opening a bank account

Question

I have recently moved to Ireland. However, I don’t have any utility bills yet and I want to open a bank account.  How can I satisfy the bank as to my identity?

Answer

Before you open an account with a financial institution, they have to establish your identity and verify your address. This requirement is set down in anti-money laundering legislation. Financial institutions include banks, building societies and credit unions.

You can prove your identity with one of the following:
·         A valid passport or current Irish driving licence
·         A National Age Card (issued by An Garda Síochána)
·         An identification form with a photograph signed by a member of An Garda Síochána
·         Documents issued by government departments showing your name, for example, a Public Services Card

You can provide evidence of your address with one of the following (which must show your address):
·         A current utility bill (such as a gas, electricity or telephone or mobile phone bill)
·         A current car or home insurance policy
·         A document issued by a government department
·         A certificate of tax credits  issued by the Revenue Commissioners
·         A current balancing statement (‘ Form P21’)  or a C2 certificate from the Revenue Commissioners
·         A social insurance document

Note that you cannot use the same document to prove your identity and your address. Alternatively, you can provide a letter from your employer or licensed employment agency stating that you have recently arrived in Ireland and have started work but cannot yet provide evidence of your Irish address (you will have to provide evidence of your address at a later date). If you open an account that pays interest on your money, you also need to supply your PPS (Personal Public Service) number. If you do not have a PPS number, you can contact your local social welfare office for information on how to apply for one.

Know Your Rights: Home Renovation Incentive

Question

I need to carry out some house repairs. What is the new scheme for home renovation that was announced in Budget 2014?

Answer

The Home Renovation Incentive (HRI) is a new scheme that enables homeowners to claim tax relief on repairs, renovations or improvement work carried out on their homes. The incentive will be paid in the form of a tax credit at 13.5% of qualifying expenditure, which can be set against your income tax over 2 years. You must be paying income tax – under PAYE or self-assessment – to avail of the incentive. You must also be up to date with your Local Property Tax obligations.

Any contractor you use must be registered for Value Added Tax (VAT) in Ireland and be tax-compliant. If several contractors, such as a builder, a plumber and an electrician, carry out qualifying work on your home, you can combine the cost of the works to make up the minimum qualifying expenditure of €5,000 excluding VAT at 13.5%. (The maximum qualifying expenditure is €30,000 excluding VAT at 13.5%).

Repair, renovation or improvement work subject to VAT at 13.5% all qualify for the HRI,  including extensions, garages and attic conversions; the supply and fitting of kitchens, bathrooms and built-in wardrobes; fitting of windows; plumbing, tiling, rewiring and plastering. Work subject to VAT at 23% (such as architect’s fees) is not covered. Neither are items such as furniture, white goods or carpets.

The work must be carried out and paid for between 25 October 2013 and 31 December 2015. Qualifying work between 25 October 2013 and 31 December 2013 will be treated as if it was carried out and paid for in 2014. In general, the tax credit will be payable over the 2 years following the year in which the work is carried out and paid for. If you are a PAYE taxpayer, the amount of the allowable credit will be included in your annual Tax Credit Certificates. If you are a self-assessment taxpayer, it will be incorporated into your tax assessment.

Caithfear le hobair incháilithe idir an 25 Deireadh Fómhair 2013 agus an 31 Nollaig 2013 amhail ar déanta agus ar íocadh aisti i 2014. Go ginearálta, beidh an creidmheas cánach le híoc thar an dá bhliain i ndiaidh na bliana ina ndéantar an obair agus ina n-íoctar aisti. Know Your Rights: Jury service November 2013

Question

I have received a summons from the County Registrar to attend court for jury service. I am worried that I won’t get my jobseeker’s payment if I am selected. What happens if I just don’t turn up?

Answer

You can’t ignore the summons to attend the court. If you fail to attend for jury service without a reasonable excuse, you may be fined. If you are called for jury service while you are signing on for a jobseeker's payment you will continue to get your payment.
You must reply to the jury summons using the form and pre-paid envelope.
Certain categories of people are excused by right from sitting on a jury. Even if you are excusable by right you can choose to do jury service if you wish. People excusable by right include people over 65, people who provide an important community service, politicians and those in religious life. If you come within one of these categories, you must state this on the form provided.
If you wish to be excused for another reason (such as illness), you state that reason on the form and the County Registrar will make a decision as to whether you may be excused. All summonsed jury members who are not excused must attend in court on the first day the panel is formed. The name of every juror is called out and you must answer to show you are in attendance.
Names are drawn out of a ballot box to select a panel of twelve jurors for a particular case. Even though you are called for jury service, you may not actually serve on a jury. Usually more people are called than are needed. You must return to court every day, whether or not you are sworn onto a jury panel, unless otherwise directed by the court.
There is no payment for jury service but as noted above you can keep your jobseeker’s payment while you serve on a jury. You should advise your local social welfare office or Intreo centre that you have been called for jury service.

Know Your Rights B: Non-Principal Private Residence Charge arrears

Question

My cousin who lives in England never paid the Non-Principal Private Residence (NPPR) charge on a property he inherited in Ireland because he was not aware of the charge. What should he do to ensure that his affairs are in order?

Answer

The Non-Principal Private Residence (NPPR) charge was introduced on 2009 for residential property that is not the owner’s only or main residence. This charge is payable to the local authority. The NPPR continues to apply for the year 2013.The NPPR will no longer be charged after 2013, but outstanding liabilities and payments will still be collected and these can be substantial.
The NPPR charge is €200 for each relevant property you own on 31 March each year and it should have been paid by 30 June each year. A late fee of €20 was charged for each month, or part of a month, after 30 June of each relevant year. These fees and penalties increase each month and if you have never paid the NPPR, the total due since 2009, together with late fees and penalties, would now be well over €3,000. A table of charges available online at nppr.ie shows how much is due. For example, if you were liable for the NPPR since 2009 and have never paid it, you will owe €3,720 in October 2013.
Your cousin should arrange to pay the outstanding charges for 2009, 2010, 2011, 2012 and 2013 plus the late fees that have accrued. He should register the property and pay the charge online at nppr.ie or else use a paper form.
He should also ensure that any other taxes and charges have been paid – such as the Household Charge (payable on the property for the year 2012 in addition to the NPPR), the new  Local Property Tax (LPT) and the septic tank registration charge (if relevant).

Is ionann muirear an NPPR agus €200 do gach maoin ábhartha atá agat an 31 Márta gach bliain agus ba cheart go n-íoctar é faoin 30 Meitheamh gach bliain. I am taking my 3-year-old on holidays abroad. Her surname is different from mine and I’m not in touch with her father, my ex-partner. Can I put her on my passport?

Answer

All Irish citizen children, regardless of age, must have an individual passport in their own name if they are travelling abroad. An application for a passport for a child living in Ireland is made on form APS 1 (pdf), and the child's full birth certificate, showing the parents’ names, must be submitted with it. The application form includes a section for parental consent, which must be signed.

Joint guardians of a child

If you and your child’s father are joint guardians of your child, both of you should sign the parental consent section of the application form. However, if you are not in touch with him, or if he does not consent, you can apply to the District Court for a court order, which will allow the Passport Office to issue the passport without his consent.

(Married parents are automatically joint guardians. If the parents are not married, the mother is automatically the sole guardian, but the father can arrange to become a joint guardian.)

Sole guardian of a child

If you are the sole guardian of your child, but the father's name is on the birth certificate and he agrees with you to sign, both of you can sign the parental consent section. If his name is not on the birth certificate, or if he doesn’t sign the parental consent section, you will have to provide an affidavit (AFF 1) stating that you are the sole guardian. (This also happens if the other parent/guardian is deceased, and you will also need a death certificate in this case.)

Extra documentation

The additional documentation that needs to accompany the passport application depends on several factors, including when and where the child was born.

Some countries require you to have further additional documentation for a child, as well as the passport – it’s worth checking this out before you travel.

Know Your Rights A: Appealing your Leaving Certificate results

Question

Can I get a Leaving Certificate exam paper re-checked if I think that it has been marked wrongly?

Answer

Yes, if you are not satisfied with the marks in one or more of your Leaving Certificate exams, you can appeal them to the State Examinations Commission. Before you make the decision to appeal a result, you may view your exam paper and then make your decision. The State Examinations Commission will send your school personalized application forms for you to view your exam papers and to appeal your results. (For external candidates, these forms are enclosed with your examination results.)

Viewing: If you decide you would like to view a particular paper, you mark the form accordingly. There is no charge for viewing your papers. You must return the completed form to your school by 20 August 2013. The Organizing Superintendent appointed by the State Examinations Commission will assign you to one of the viewing sessions. These will take place on 30 and 31 August 2013 in your school or examination centre.

Appealing: If you decide to appeal your results, you indicate the subjects you wish to appeal on the appeal application form and you pay the appeal fee. Your application to appeal your 2013 results must be received by 4 September 2013.

Your paper will be re-marked by an appeal examiner, who will be different from the examiner who originally marked your work. The same marking scheme is used for re-marking. Your result may be upgraded, left the same or downgraded as a result of an appeal. There is further information about the appeal process on the website of the State Examinations Commission, examinations.ie.

If you are not happy with the outcome of your appeal, you may request a review by the Independent Appeals Scrutineers. Application forms for an appeal review are provided with your appeal results.

Is féidir. Mura bhfuil tú sásta leis na marcanna i scrúdú Ardteistiméireachta amháin nó níos mó, féadfaidh tú iad a achomharc le Coimisiún na Scrúduithe Stáit. I have been getting Rent Supplement for nearly a year. I have been told that my Rent Supplement is being reviewed. What does this mean? Will I lose my Rent Supplement?
Answer
Your claim for Rent Supplement is reviewed regularly, usually every six months. During the review you will be asked to complete a Rent Supplement Review Form (your landlord will have to fill out part of this form). You should return this to the Department of Social Protection (DSP) officer dealing with your claim. The officer will examine the form to make sure that you are receiving the right amount of Rent Supplement. The maximum rent limits for Rent Supplement are reviewed regularly and the latest limits are effective from 17 June 2013. In some cases the officer dealing with your claim may visit your accommodation to confirm the tenancy and the type of accommodation. You should return the form as soon as possible to the officer to ensure there is no delay to your payment.

If your circumstances have not changed since you started getting Rent Supplement you should continue to get your payment. If your circumstances change while you are getting Rent Supplement (for example, if you get extra work or the number of people living in the household changes) you should contact the DSP officer dealing with your claim immediately. You should not wait until your review as this may mean that you are overpaid Rent Supplement which you will have to repay.

If you refuse two offers of social housing from a local authority within a 12-month period, your Rent Supplement will be stopped and you will not be allowed to claim Rent Supplement for 12 months.
