Question
I work part-time from Monday to Wednesday. This year Christmas falls on a Thursday. Will I get paid for Christmas Day and St Stephen’s Day, even though I don’t work on those days? What about New Year’s Day which falls on the following Thursday?
Answer
Christmas Day, St Stephen’s Day and New Year’s Day are public holidays. Christmas Eve and New Year’s Eve are not. All workers are entitled either to paid time off or pay for a public holiday. (Your employer can decide whether to give you time off or pay.)
Part-time workers must have worked for the employer for at least 40 hours in the previous five-week period to have a public holiday entitlement.
If you work part-time and the public holiday falls on a day that you usually work you are entitled to a day’s pay or a paid day off for the public holiday. Part-time workers who are not rostered to work on a public holiday are still entitled to be paid or to paid time off for the public holiday. Part-time workers get one-fifth of their normal pay for the week as compensation for the holiday.
If you are required to work on a public holiday you are entitled to be paid at your usual rate and you are also entitled to either an additional day’s pay or a paid day off.
In your case you should receive one-fifth of your normal weekly pay for each of the three public holidays, Christmas Day, St Stephen’s Day and New Year’s Day. So you should get the additional pay or the equivalent amount of time off. Your employer can decide which option to give you.

Know Your Rights: Solutions for problem debt November 2014

We borrowed a lot to pay for our children’s college fees and weddings, when we both had good incomes. We now earn less than before and find it very hard to cover our debts. We’re afraid to open letters or answer the phone in case it’s another demand for payment. Is there any help for people like us?
Answer
You are clearly in financial difficulty and struggling with your debts. There are many people in a similar situation.
Three debt solutions have been set up to help people with serious debt problems to sort out their situation and get protection from their creditors. They are the Debt Relief Notice (DRN), Debt Settlement Arrangement (DSA) and Personal Insolvency Arrangement (PIA).
The appropriate solution for you depends on the size of your debts and whether or not you have a mortgage. You apply through an Approved Intermediary for a DRN and through a Personal Insolvency Practitioner for a DSA or PIA. These qualified insolvency professionals are supervised by the Insolvency Service of Ireland (ISI).
When the solution has been put in place, your creditors cannot contact you while you stick to the agreed arrangements. Depending on your situation, some or all of your debt can be written off.
Many Money Advice and Budgeting Services (MABS) companies have been authorised as Approved Intermediaries to help people on low incomes, with debts under €20,000, through the Debt Relief Notice (DRN) process.
For a DSA or PIA, which generally cover larger debts, your creditors must agree to the solution proposed by your Personal Insolvency Practitioner. If they don’t agree, you then have the option of bankruptcy.

Question
I paid the Local Property Tax by credit card this time last year. Is it the same amount for 2015 and how do I pay? 
Answer 
Your Local Property Tax (LPT) is based on the valuation of your property on 1 May 2013. However, the rate you pay for 2015 may vary from the 2014 rate, following the introduction of the local adjustment factor. This means that the basic LPT rates can be adjusted up or down by up to15% in different local authority areas. Fourteen local authorities have reduced 2015 LPT rates in their areas by up to 15%. You can use Revenue's online calculator to check how much LPT is payable in different local authority areas.
As you paid your LPT for 2014 in one lump sum, you will get a letter from Revenue (or an email if you are a ROS customer) telling you whether your local authority changed the rate for 2015 and confirming the amount of LPT due. If you own more than one property, the letter will confirm the total amount due for all your properties. It will include your Property ID and PIN. 
When you get this letter you must confirm how you want to pay your 2015 LPT to Revenue. You can choose to continue to pay your LPT in the way you paid it in 2014 or you can change your payment method. You will recall from last year that, if you pay by credit card, the deduction will be made on the day that the transaction is completed online.
You must contact Revenue by 25 November 2014 if you want to switch to a phased payment method or by 7 January 2015 if you want to pay in full in one lump sum. The easiest way to do this is to use the LPT online system. If you need help with the online system you can call the LPT helpline on 1890 200 255.
People who didn’t pay their 2014 LPT in a lump sum do not get a letter from Revenue and they do not need to do anything unless they want to change their payment method. Revenue will apply any rate reductions automatically.  You can get more information from Revenue.

Question

I live alone and get a State Pension. Will I be able to get any help with the new water charges?

Answer

Domestic water charges will apply from 1 October 2014 and the first bills will issue from January 2015. A free allowance of a certain amount of water will be provided for every household, with extra allowances for children. If you are getting the Household Benefits Package, you will also get help with the cost of water charges.

From January 2015 the Household Benefits Package will include a new annual Water Support payment of €100 (made up of four equal payments of €25). The Water Support payment will be paid to everyone who qualifies for the Household Benefits Package. This includes people who are not customers of Irish Water and who either have their own water supply or are members of a group scheme.

If you are currently getting the Household Benefits Package and get your allowance as a credit on your bill, the Department of Social Protection (DSP) does not hold payment details for you. In September 2014 the DSP contacted customers to ask them to complete a form with their bank account information so the Water Support payment can be paid directly. The Water Support payment can also be paid in post offices.

The Water Support payment will be paid directly to you, not to Irish Water. If your home is connected to a public water supply (or to public wastewater services) you will need to set up an account with Irish Water to pay your water charges and to claim the free household allowance. Irish Water has sent customer application packs to all households, to be returned by 31 October 2014.

Know Your Rights : Importing a car

Question

I’m living in Ireland but I want to buy a second-hand car in the UK. What steps do I have to take when I bring the car to Ireland?

Answer

Within seven days of bringing the car to Ireland you must make an appointment to bring the car to your local National Car Testing Service (NCTS) centre in order to register it and pay Vehicle Registration Tax (VRT). See ncts.ie to book an appointment and for details of the documents you need to bring with you.

The car will be examined at the NCTS centre and the details will be used by Revenue to assess the amount of VRT payable, based on the value of the car. Revenue provides an online VRT Calculator that you can use to get an estimate of how much you will have to pay, see revenue.ie. You pay the VRT to the NCTS. You must complete the registration process within 30 days of the vehicle's arrival in Ireland.

You will get a receipt for the VRT paid, showing the new registration number for your car. You must display this number on your car within three days. You can buy registration number plates at the NCTS centre or at a motor factors.

You will also get Form RF100, which you will need when you pay motor tax. To pay motor tax, you will also need to insure the car and have your insurance details. You can pay motor tax online at motortax.ie or at the Motor Taxation Office of your local authority.

After you have paid the motor tax, the Vehicle Registration Certificate will be issued to you by the Department of Transport, Tourism and Sport.

If the car is four years old or more it must also undergo the National Car Test immediately.

Know Your Rights : Vaccinations when travelling abroad

We are planning a round-the-world trip later this year. Should we think about getting vaccinations?

Answer
You should consider getting vaccinations if you are travelling outside of Western Europe, North America, Australia, and New Zealand. Health risks vary from country to country, so you will need to get advice about this well before you travel – ask your family doctor, the Health Service Executive (HSE) or your travel agent.

You will also find relevant information on the World Health Organization Country List. The HSE website has information on the different types of vaccines, such as those for cholera or tuberculosis – hse.ie.

Travel vaccinations are not covered by the medical card so you will have to pay the full cost for them.

Start the process of vaccination in good time before you travel. Some vaccines take time to become effective, so give yourself at least 8 weeks for full protection.

An early start is particularly important if you plan to travel with children. The BCG vaccination against tuberculosis (TB), for example, should be given at least 3 months before your child travels.

Some countries require you to have certain vaccinations and you will need to show an International Certificate of Vaccination in order to gain access to these countries. Other vaccinations are recommended and you can decide yourself whether to get them.

If you feel unwell on your return to Ireland, you should see a doctor as soon as possible. Give full details of the countries you visited.

Know Your Rights : Getting an ‘apostille stamp’

Question

I was born in London and I have an Irish passport. I am getting married later this year in Dublin. I have been told that I must provide a birth certificate with an apostille stamp. My Irish fiancé has not been asked to produce this certificate. Why is this?

Answer

The Civil Registration Act 2004 requires both people getting married in the Republic of Ireland to provide evidence of their identities, civil status, age and nationality. If either person was born outside of the State, an authenticated birth certificate is required. Since you were born in the United Kingdom, you need such a birth certificate, even if you are entitled to an Irish passport.

The Hague Convention (1961) specifies how a document issued in one of the signatory countries can be authenticated or certified for legal purposes in all the other signatory states. Such a certification is called an apostille (in French this means certification). An apostille stamp is an international certification, like a notarisation in domestic law, which authenticates or legally certifies a document.

The Irish Department of Foreign Affairs and Trade (including staff in Irish embassies, consulates and honorary consulates overseas) can authenticate documents for Irish-born people getting married abroad.

What is the ‘Energy Engage’ Code?

Answer
The ‘Energy Engage Code’ is a new code of practice which aims to protect energy customers who are in financial difficulty, particularly those in arrears on their bills. It applies to five energy suppliers with effect from 1 June 2014 – these are Bord Gáis Energy, Electric Ireland, Energia, Flogas Natural Gas and SSE Airtricity.
Under the Energy Engage Code, suppliers guarantee that no customer engaging with them will be cut off. The energy suppliers will seek to identify vulnerable customers at an earlier stage. They commit to treating each customer individually and offering realistic and achievable payment plans to customers in difficulty. The Energy Engage Code will be independently audited to ensure that the participating energy suppliers are complying with it.
In addition to the new code of practice, all energy suppliers must comply with certain mandatory consumer protection standards that are set out by the Commission for Energy Regulation (CER).

All suppliers are obliged to establish a register of vulnerable customers and to keep it updated. Customers listed on this register cannot be disconnected during the months November to March. A customer in arrears must be offered a payment arrangement, which can include the installation of a Pay As You Go meter, while avoiding a situation where the debt becomes worse.

“At risk” customers must be referred to MABS, The St Vincent de Paul Society or a representative of the Department of Social Protection (formerly called the Community Welfare Officer). A supplier can consider applying for a disconnection only if these measures fail, and only after at least four separate attempts to contact the customer have been made.

Question

My small business is not doing well at present so my income has dropped substantially. Am I entitled to any social welfare payment?

Answer

If the amount of work you are getting from self-employment has reduced so much that it no longer provides a sufficient income, you may qualify for Jobseeker’s Allowance. You must meet all the conditions to qualify for this payment, including a means test, but you do not need to close your business or stop working as a self-employed person.

The earnings from your business will be assessed in the means test. The assessment must reflect the income that you may reasonably be expected to get from your business over the next 12 months. Income for the last 12 months will be taken as a guide, but the means test will also allow for any factors that are likely to vary. You should be prepared to discuss these factors when you are being assessed for the payment.

Your earnings over the 12 months are assessed as your gross income minus work-related expenses. Your expected annual earnings from self-employment are divided by 52 to find your weekly means from self-employment.

Usually, you will be asked for your receipts and payments or audited accounts for the current and previous year. For example, if you apply for Jobseeker’s Allowance in May 2014, you will be asked for your receipts and payments from January 2014 to May 2014 and for 2013. However, in certain cases you may be required to show audited accounts for the last two or more years.

You may qualify for Supplementary Welfare Allowance while you are waiting to be assessed for Jobseeker’s Allowance or if a decision is made that you don’t qualify for Jobseeker’s Allowance.

Boscaí Bruscar – Litter Bins
A number of the roadside litter bins situated at various locations around the island have been removed.  The bins were removed as there is no arrangement in place for the servicing of them.  Comharchumann Árainn Mhór has not been responsible for the servicing of the bins and all servicing of bins to date by an comharchumann was undertaken on a voluntary basis.  Many of the bins in question were regularly filled with household waste such as dogfood tins and children’s nappies.     
Following consultations between an Comharchumann,  Donegal Co Co and the waste removal operator, it has been agreed that a number of the bins will remain in place and they will be serviced on a regular fortnightly basis. 
It should be noted that the bins are not for the use of householders for the disposal of household waste.  Householders are responsible for the responsible disposal of their own household waste.  The roadside bins are for general roadside litter only. 

An island map illustrating the litter bins which will be regularly serviced will follow in due course.

An Comharchumann is compiling a list of out of order street lights requiring repair, for  the ESB.  The light  number of any lights which are not working can be reported to an comharchumann via facebook/phone/in the office. Reported lights can then be included on the ESB list.

Tá deontas de €504.40 ceadaithe ag DLDC do Chomharchumann Oileán Árainn Mhór Teo faoin Chlár Forbartha Áitiúil & Pobail, chun taispeántais stairiúil faoi theacht cumhacht aibhléise chun an oileáin sna 50ídí, a fhoilsiú agus a chur ar thaispeáint sa Chultúrlann.  Nuair a thiocfaidh an taispeántas chun an oileáin, beidh sé ar thaispeáint ar dtús in Ostan an Ghleanna ar feadh roinnt seachtainí.
Comharchumann Oileán Árainn Mhór is in receipt of grant approval of €504.40, from DLDC under the Local & Community Development Programme, for the provision of a historical exhibition of the arrival of electrical power to the island in the 50s which will be on display in an Chultúrlann. 

On the arrival of the pop-up exhibition to the island, it will initially be on display in The Glen Hotel for a number of weeks.

Know Your Rights A: Older jobseekers and signing on

January 2014

Question

I have to retire next summer when I reach the age of 65 but I have heard I won’t get a State pension until I am 66. Is there another social welfare payment that I can get until then?

Answer

Yes, you can claim a jobseeker’s payment. If you have enough social insurance contributions you can get Jobseeker’s Benefit (JB). If you are claiming JB at the age of 65 and have at least 156 PRSI contributions, you can continue to receive JB until your 66th birthday even if your claim is due to end before that date. Otherwise you may apply for Jobseeker’s Allowance which is a means-tested payment.

Before 2014, people aged 65 who retired from work could apply for the State Pension (Transition). This has now been abolished from 1 January 2014. If you wish you can claim a jobseeker’s payment until you are aged 66.

In general, to qualify for either Jobseeker’s Benefit or Allowance you must be genuinely seeking work and be available for full-time employment and these conditions will continue to apply to older jobseekers. However there are special arrangements for jobseekers aged 62 and over:

  • You will no longer be required to engage with employment, advice and training referral services and your payment won’t be affected by non-engagement with these services
  • If you wish you can avail of a range of supports (for example, training or employment support programmes) from the Department of Social Protection

Most jobseekers aged 62 or over will be placed on an annual signing arrangement with their local social welfare office or Intreo centre (this means that they do not need to attend and sign on regularly). Also, most of them will be transferred to Electronic Fund Transfer payments so payment can be made directly into their bank account.
