Know Your Rights B: Non-Principal Private Residence Charge arrears

Sept/Oct 2013

Question

My cousin who lives in England never paid the Non-Principal Private Residence (NPPR) charge on a property he inherited in Ireland because he was not aware of the charge. What should he do to ensure that his affairs are in order?

Answer

The Non-Principal Private Residence (NPPR) charge was introduced on 2009 for residential property that is not the owner’s only or main residence. This charge is payable to the local authority. The NPPR continues to apply for the year 2013.The NPPR will no longer be charged after 2013, but outstanding liabilities and payments will still be collected and these can be substantial.
The NPPR charge is €200 for each relevant property you own on 31 March each year and it should have been paid by 30 June each year. A late fee of €20 was charged for each month, or part of a month, after 30 June of each relevant year. These fees and penalties increase each month and if you have never paid the NPPR, the total due since 2009, together with late fees and penalties, would now be well over €3,000. A table of charges available online at nppr.ie shows how much is due. For example, if you were liable for the NPPR since 2009 and have never paid it, you will owe €3,720 in October 2013.
Your cousin should arrange to pay the outstanding charges for 2009, 2010, 2011, 2012 and 2013 plus the late fees that have accrued. He should register the property and pay the charge online at nppr.ie or else use a paper form.
He should also ensure that any other taxes and charges have been paid – such as the Household Charge (payable on the property for the year 2012 in addition to the NPPR), the new  Local Property Tax (LPT) and the septic tank registration charge (if relevant).

Bíodh Eolas Agat ar do Chearta B: Riaráistí an Mhuirir ar Áit Chónaithe Phríobháideach Neamhphríomha

Mean Fómhair/ Deireadh Fómhair 2013

Ceist

Níor íoc mo chol cheathrar, a chónaíonn i Sasana, an Muirear ar Áit Chónaithe Phríobháideach Neamhphríomha (NPPR) ar mhaoin a fuair sé le hoidhreacht in Éirinn mar gheall nár cuireadh ar an eolas é faoin muirear. Céard ba cheart dó a dhéanamh lena chinntiú go bhfuil a chuid gnóthaí in ord?

Freagra

Rinneadh an Muirear ar Áit Chónaithe Phríobháideach Neamhphríomha (NPPR) a thabhairt isteach i 2009 i dtaca le maoin chónaithe nach í an t-aon mhaoin atá ag an úinéir agus nach í príomháit chónaithe an úinéara. Tá an muirear seo le híoc leis an údarás áitiúil. Leanann an NPPR bheith i bhfeidhm don bhliain 2013. Ní ghearrfar an NPPR a thuilleadh do na blianta i ndiaidh 2013, ach baileofar dliteanais agus íocaíochtaí nár íocadh go fóill, agus tarlaíonn sé go mbíonn iad seo mór a dhóthain.
Is ionann muirear an NPPR agus €200 do gach maoin ábhartha atá agat an 31 Márta gach bliain agus ba cheart go n-íoctar é faoin 30 Meitheamh gach bliain. Gearradh táille dhéanach €20 le haghaidh gach míosa, nó cuid de mhí, tar éis an 30 Meitheamh den bhliain ábhartha. Méadaítear na táillí agus na pionóis seo gach mí agus murar íoc tú an NPPR riamh, b’ionann an méid iomlán a bheadh le híoc ó 2009 i leith, mar aon le táillí agus pionóis dhéanacha, agus cuid mhaith os cionn €3,000. Tá fáil ar tháblaí táillí ar líne ag nppr.ie a léiríonn cé mhéid atá le híoc. Mar shampla, má bhí ort an NPPR a íoc ó 2009 i leith agus murar íoc tú é riamh, beidh €3,720 le híoc agat i nDeireadh Fómhair 2013.
Ba cheart do do chol ceathrar a shocrú chun na muirir gan íoc le haghaidh 2009, 2010, 2011, 2012 agus 2013 a íoc, mar aon leis na táillí déanacha atá fabhraithe.  Ba cheart dó an mhaoin a chlárú agus an muirear a íoc ar líne ag nppr.ie nó leas a bhaint as foirm pháipéir.
Anuas air sin, ba cheart dó a chinntiú gur íocadh aon cháin nó mhuirir eile – ar nós an Mhuirir Theaghlaigh (atá le híoc don mhaoin don bhliain 2012 anuas ar an NPPR), na Cánach nua Maoine Áitiúla (LPT) agus an mhuirir chláraithe umair sheiptigh (más cuí).

Know Your Rights : Passport for a child

Know Your Rights : Passport for a child

 September 2013

Question

I am taking my 3-year-old on holidays abroad. Her surname is different from mine and I’m not in touch with her father, my ex-partner. Can I put her on my passport?

Answer

All Irish citizen children, regardless of age, must have an individual passport in their own name if they are travelling abroad. An application for a passport for a child living in Ireland is made on form APS 1 (pdf), and the child's full birth certificate, showing the parents’ names, must be submitted with it. The application form includes a section for parental consent, which must be signed.

Joint guardians of a child

If you and your child’s father are joint guardians of your child, both of you should sign the parental consent section of the application form. However, if you are not in touch with him, or if he does not consent, you can apply to the District Court for a court order, which will allow the Passport Office to issue the passport without his consent.

(Married parents are automatically joint guardians. If the parents are not married, the mother is automatically the sole guardian, but the father can arrange to become a joint guardian.)

Sole guardian of a child

If you are the sole guardian of your child, but the father's name is on the birth certificate and he agrees with you to sign, both of you can sign the parental consent section. If his name is not on the birth certificate, or if he doesn’t sign the parental consent section, you will have to provide an affidavit (AFF 1) stating that you are the sole guardian. (This also happens if the other parent/guardian is deceased, and you will also need a death certificate in this case.)

Extra documentation

The additional documentation that needs to accompany the passport application depends on several factors, including when and where the child was born.

Some countries require you to have further additional documentation for a child, as well as the passport – it’s worth checking this out before you travel.

Bíodh Eolas Agat ar do Chearta : Pas linbh

Meán Fómhair 2013

Ceist

Beidh m’iníon 3 bliana d’aois ag teacht liom ar laethanta saoire thar lear. Tá sloinne éagsúil aici ó mo shloinne féin agus ní bhíonn aon teagmháil idir mé féin agus a hathair, m’iarpháirtnéir. An féidir liom í a chur ar mo phas féin?

Freagra

Ní mór go mbeidh ag gach leanbh atá ina shaoránach Éireannach a phas aonair ina ainm féin má tá sé ag taisteal thar lear, gan aird ar aois. Déantar iarratas ar phas do leanbh a chónaíonn in Éirinn ar fhoirm APS 1 (pdf), agus ní mór teastas iomlán breithe an linbh, a léiríonn ainmneacha na dtuismitheoirí, a sheoladh isteach in éineacht leis. Áirítear leis an bhfoirm iarratais mír le haghaidh toiliú tuismitheora, nach mór a shíniú.

Comhchaomhnóirí linbh

Más comhchaomhnóirí do linbh tú féin agus athair do linbh, ba cheart daoibh beirt an mhír ‘toiliú tuismitheora’ a shíniú ar an bhfoirm iarratais. Mura mbíonn teagmháil agat leis, áfach, nó mura dtoilíonn sé, féadfaidh tú iarratas a dhéanamh ar an gCúirt Dúiche chun ordú cúirte a fháil, a ligeann d’Oifig na bPasanna an pas a eisiúint gan a thoiliú.

(Déantar comhchaomhnóirí go huathoibríoch de thuismitheoirí pósta. Mura bhfuil na tuismitheoirí pósta, déantar an caomhnóir aonair den mháthair go huathoibríoch, ach féadfaidh an t-athair socruithe a dhéanamh go ndéanfar comhchaomhnóir de.)

Caomhnóir aonair linbh

Más tú caomhnóir aonair do linbh, ach má tá ainm an athar le sonrú ar an teastas breithe, agus má chomhaontaíonn sé leat chun í a shíniú, is féidir libh beirt an mhír ‘toiliú tuismitheora’ a shíniú. Mura bhfuil a ainm ar an teastas breithe, nó mura síníonn sé an mhír ‘toiliú tuismitheora, beidh ort mionnscríbhinn (AFF 1) a sholáthar ina luaitear gur tusa an caomhnóir aonair. (Tarlaíonn seo, chomh maith, má fuair an tuismitheoir/caomhnóir eile bás, agus teastaíonn teastas báis uait sa chás seo, chomh maith.)

Cáipéisíocht bhreise

Braitheann an cháipéisíocht bhreise nach mór gabháil leis an iarratas ar phas ar roinnt tosca, lena n-áirítear cathain agus cén áit ar rugadh an leanbh.

Ceanglaíonn roinnt tíortha ort níos mó cáipéisíocht bhreise a bheith agat do leanbh, mar aon le pas – is fiú é seo a dheimhniú sula ndéanann tú taisteal.
